Know Your Rights

10 April 2023

For the first 12 weeks of pregnancy, the Choice on Termination of Pregnancy Act No. 92 of 1996 ensures that all women have the legal right to have an abortion (also known as a termination of pregnancy) at no cost at a government-run hospital or clinic.

According to the Act, the surgery may also be carried out between the 13th and 20th week of a pregnant woman's gestation if the medical practitioner, after consulting with the pregnant lady, is of the opinion that:

The continuation of the pregnancy is associated with an increased risk of adverse effects on the woman's physical and mental health.
that there is a significant possibility that the unborn child may have a serious mental or physical defect as a result of the pregnancy.
If the pregnancy was the product of rape or an act of incest, then.
if the woman's current social or financial circumstances would be drastically altered if she proceeded to carry the baby to term.
Following the 20th week of pregnancy, if a medical practitioner considers, after consulting with a licensed midwife, that the prolonged pregnancy might pose the following risks:

would put the life of the lady in jeopardy.
This would lead to a serious deformity in the developing embryo as a consequence.
Would put the unborn child in danger of suffering harm.
Women of any age have the legal right to terminate a pregnancy, and it is unacceptable to deny any woman access to this service solely on the basis of her age. Provisions will be made for females who are not accompanied by an adult, despite the fact that it is recommended for minors under the age of 18 to be supported by a reliable adult (such as a parent, aunt, or teacher) in their presence, although this is not required.

If you are thinking about having an abortion, you should see a nurse practitioner about the most reliable procedures that are accessible to you.

Abortions performed surgically
Abortions performed medically simply involve the use of medicine (in the form of pills or tablets). To successfully terminate the pregnancy, a patient will take two separate medications. The patient will take the first tablet (one tablet of mifepristone) in the clinic or hospital, and then they will take the remaining pills (four tablets of misoprostol) between one and two days later at their own residence. After taking the second pill, you will experience discomfort and bleeding within four to six hours, and then your pregnancy will end. A woman may have symptoms that are comparable to those of a miscarriage. This option is accessible to women who are 4 to 9 weeks pregnant, and it is provided by a licensed nurse or Midwife. Moreover, this option is available to women who are 10 to 13 weeks pregnant, and a medical practitioner will administer it to those women.

Abortions Performed Surgically
Abortions that are conducted surgically may be done so by registered nurses (up to 12 weeks of pregnancy) or by medical professionals (from 12 to 20 weeks of pregnancy) in a clinic or hospital setting on the same day as the surgery. After the ingestion of pills that lubricate and relax the mouth of the womb, the surgery itself will be performed on women who have made the decision to undergo this treatment. In a few hours, after the woman's vital signs have returned to normal, she will be discharged from the hospital and allowed to return home. She will be provided with pain medication to assist her in coping with the contradictions, a patient information leaflet to assist her in recognizing any potential danger signs, and a recommended method of birth control due to the fact that her fertility may return as soon as 8 days after the procedure.
